What is Spousal Support?
Spousal Support is known as “Spousal Maintenance” under the Texas Family Code and refers to payments made to an ex spouse post divorce. Its often called spousal support or alimony but its not like the alimony you hear about from California or other more liberal states. In Texas Spousal Maintenance is very restrictive and in most cases you can’t even qualify for it unless you’ve been married for at least 10 years and the maintenance amount is to be what is required to provide for a spouses “minimum reasonable living needs.” This is not meant to be a large sum of money and the courts tend to be quite restrictive on the amounts and duration of support awarded.
In order to pursue or defend against spousal maintenance claims you have to have an experienced Divorce lawyer that can properly prepare your case to protect your rights.
What is an uncontested divorce?

How do temporary orders work?
Temporary Orders are order put in place by the court after a hearing and they are designed to maintain the status quo, preserve property, and protect the safety and wellbeing of the parties and children. Usually when a party files for divorce in a contested case, they request that the court render temporary orders for the pendency of the case. At such a hearing, the court will hear live testimony and then make orders such as awarding one spouse exclusive use and possession of the marital residence, order the spouses to pay certain bills, dividing up bank accounts, awarding temporary custody for the children and the payment of child support, as well as the appointment of experts to value the estate or investigate the circumstances surrounding custody of the children.
Most property is in my spouse's name, what happens?
In most cases, it won’t matter whose name the property is titled in, provided it was acquired during the marriage. When property was purchased prior to the marriage, it is considered “Separate Property” and the court cannot divide these types of assets and when property is titled solely in one spouses name it does help support a claim of separate property, but its only one factor to consider. In a divorce, property is either considered Separate Property or Community Property. The court can only divide community property and it must do so in a just and right division.
Separate Property is property that was acquired:
- Before the marriage,
- as a gift, or
- as inheritance
Everything acquired during the marriage that is not separate property is community property regardless of whose name it is in primarily.
How are Assets and Liabilities Divided?
The court will divide the marital estate (assets and liabilities) in a just and right division. However, what is “just and right” depends upon a variety of factors including fault reasons for divorce, earning potential of spouses, length of marriage, children, disabilities, age of spouses, health of spouses, bad behavior during the marriage, and etc. In most instances the court will aim for a split of approximately 50/50 but its certainly not uncommon for the splits to be 55/45, 60/40, or even 65/35. However, its important that all the legal documents are drawn up correctly to adequately transfer the property. If it’s done incorrectly, it can cost thousands to fix and in some cases it cannot be fixed at all.
When it comes to the division of debts things can get a bit more difficult. Debts are a contractual agreement between the borrower and the lender. The court cannot do anything to alter that contract and impose a binding decision on the lender. The most common example is when 1 spouse has the majority of the debt in their sole name but all of the debt was incurred by both spouses. In this scenario let’s assume $30,000 is owed to VISA and the debt is solely in Wife’s name. In the divorce the judge ordered husband to pay the $30,000. However, after the divorce, the husband may refuse to pay the debt and VISA will only pursue the wife for collection of the debt regardless of what the judge ordered. In this scenario, wife’s only recourse is to essentially sue Husband for failure to perform the court order but she would still be responsible to VISA for full payment of the debt.
In situations like that, you need to have an experienced divorce lawyer on your side that can present your case to the judge along with solutions for securing the payment of the debt though the use of liens or other legal instruments to ensure payment.

What are the grounds for divorce?
In Texas a divorce can be granted as a “no fault divorce” or a “fault based divorce” and these are all discussed under Chapter 6 of the Texas Family Code.
“Insupportability” is the no fault provision under Texas Family Code section 6.001 and it essential states that the spouses just can’t get a long and the marriage is unworkable.
The fault based grounds include the following:
- Abandonment as defined in Section 6.005
- Adultery as defined in Section 6.003
- Cruelty as defined in Section 6.002
- Confinement in a Mental Hospital as defined defined in Section 6.007
- Felony Conviction as defined in Section 6.004
- Living Apart as defined in Section 6.006.
The reason to choose a fault based ground can depend on several factors but the most important reason is that fault based divorces all the court to grant a disproportionate division of the marital estate as a way of punishing a spouse for their alleged wrong doing. If you and your spouse don’t have a large estate, a fault based divorce may not matter much to you unless its being pursued on some form of principle in which a spouse doesn’t believe in divorce unless someone is at fault. This however can be difficult because even if a fault based divorce is proven, the court can still decide to grant the divorce based on the no fault provision of insupportability. The best thing to do is hire an experienced divorce lawyer to help you make an informed decision as the pursuing a no fault or fault based divorce.
